HOW TO ENTER THE RAFFLE: The minimum donation for one ticket is $50. All entrants must purchase ticket(s) either by credit card, check, or money order at www.CaerusFoundation.org or at www.MiamiCharityRaffle.com.
Mail checks and money orders to Caerus Foundation, Inc P.O.Box 56-5055, Miami, Fl 33256. Persons purchasing raffle tickets in person will receive their raffle tickets immediately. A ticket can be purchased in the name of one individual. The ticket receipt will be mailed to the person listed on the entry form.
Special packages of 3, 10, 50 and 100 tickets can be purchased at discounted rates. Every entrant must provide a valid e-mail address, full legal name, home phone, alternate phone, physical address, mailing address. Tickets and payment confirmation will be provided electronically at time of purchase. Ticket purchases are not tax deductible in accordance with IRS regulations. All purchases of the raffle entries are final and non refundable.
Caerus Foundation, Inc. will reject any drawing ticket request if the check or credit card payment is not honored or is returned due to insufficient funds or any other reason prior and not remedied before the time of drawing. Correction of any such return or non-payment is the sole responsibility of the ticket purchaser. All federal, state and local taxes associated with receipt or use of prize, including without limitation all applicable sales, use, luxury, income and special taxes are the sole responsibility of the winner(s).Any lost, late, misdirected, incomplete, illegible, or undelivered tickets shall be deemed invalid and shall be immediately disqualified. Caerus Foundation, Inc assumes no liability for lost, late, misdirected, incomplete, illegible, or undelivered tickets. By entering the Raffle, the entry purchaser acknowledges that he or she is aware and agrees with the raffle official rules.
ELIGIBILITY: You must be 18 years or older to purchase a raffle entry. Officers, directors and employees, of Caerus Foundation, a Florida not-for-profit corporation (the “Sponsor) are ineligible to purchase raffle tickets.
An affidavit of eligibility, photo identification, taxpayer identification number, and other information will be required from prize winner(s). Void where prohibited. This is not a lottery this is a raffle by chance. All applicable federal, state, and local laws and regulations apply.
PRIZE - The Prize will be a 2010 Mercedes Benz E350 or Cash Award (if at least 1000 tickets are not sold)
If the specific car advertised becomes no longer available, a substitute car of the same year, make, & model may be chosen as a replacement. Certain features and car color may be different from the photographed representations in our advertising. Any taxes accruing as a result of the raffle, on or after the drawing date are the responsibility of the winner
ODDS: The odds of winning the Prize will depend on the number of entries, but will be no more than 1 in 20,000.
METHOD OF RANDOM DRAWING
The drawing will be held on December 30, 2009 at 6.30 pm EST at Intercontinental Hotel Miami .One (1) Winner will be determined by random drawing from among all eligible raffle tickets purchased during the Raffle Period., to be held by Caerus Foundation, Inc. No entrant(s) need be present to win. All tickets will be verified and selected by an Independent Certified Accounting Company.
Witnesses will be chosen from the audience to view the pulled raffle ticket. The accounting firm will also be present to validate the drawing.
Winner(s) name(s), and ticket numbers, will be called. The winner(s) will be called by name and verified by matching the ticket with the information in the records and the application form. Drawing date may be extended at Caerus Foundation, Inc discretion without notice. A list of the raffle winners will be posted at www.CaerusFoundation.org
SELECTION OF THE WINNER: Winner(s) must claim prizes with Caerus Foundation, Inc and sign and deliver a completed W-9 form, or other form as required by law. no later than 5:00p.m. EST ten (10) calendar days from announcement or first attempt to contact, or the prizes will be forfeited and awarded to the charity foundation. Prizes are non transferable. Actual prizes may vary from photos used in print. To claim prizes, winner(s) must follow the instructions contained in their notification. Winner(s) must present proper ID, a valid state-issued driver's license or identification certificate. Caerus Foundation, Inc reserves the right to disqualify false entries or entries suspected of being false, and any ineligible, defective, incomplete or physically altered entry forms and entries that do not include valid or complete payment. Caerus Foundation, Inc. is not responsible for printing errors in any drawing-related material, or for lost, late, misdirected or non-delivered mail, or any other failure to receive orders or deliver receipts prior to the drawing deadlines. All entries become the property of Caerus Foundation, Inc and will not be returned. Winner(s) grant permission for the use of their name(s), photographs/likenesses for advertising and promotion for this and similar promotions without compensation.
50/50 RULE: In the event that at least 1,000 tickets are not sold, the original raffle will revert to a 50/50 drawing for a cash prize with one winner. In such an event, the winner will receive 50% of the net proceeds from the sale of raffle tickets minus the charity’s expenses, with the remaining proceeds going to the non-profit organization sponsoring the event.
NOTIFICATION: - The entrant whose ticket is drawn will be deemed the winner of that raffle. Caerus Foundation, Inc. will notify winner(s) by telephone or email and U.S. certified mail return receipt on drawing day or next day. If the Winner (s) cannot be located or fails to return attempts to contact him/her by 5:00 p.m. EST 10(Ten) day after the drawing or if the winner does not respond or if for any reason does not complete all paperwork required to accept ownership of the prize within 10 days of the drawing date, ownership will be forfeited to the non-profit organization. Caerus Foundation, Inc. is not responsible for printing errors in any raffle-related material, or for lost, late, misdirected or undelivered mail, or for any other failure to deliver tickets, notifications, or receipts associated with the raffle.
GENERAL CONDITIONS: All personal information collected by Caerus Foundation, Inc will be used for administration of the drawing. Caerus Foundation, Inc will not share, sell, or otherwise distribute personal information collected except as stated above. No contribution is necessary .RAFFLE IS VOID WHERE PROHIBITED.
WAIVER/LIMITATIONS OF LIABILITY:Each person who buys a ticket and/or whose name appears on a ticket: (1) agrees that Caerus Foundation, Inc, its directors, officers, employees, agents, representatives and the home seller/donor are not responsible for any injuries, losses or damages of any kind arising in connection with, or as a result of this raffle and/or that person's failure to win or redeem any prize, or that person's award of, acceptance of or use of, any prize; and (2) releases and agrees to indemnify, defend, protect, and hold harmless Caerus Foundation, Inc and its officers, directors, shareholders, employees, agents, advertising agency, contractors, insurers, attorneys, accountants and affiliates from and against all losses, damages, rights, claims and actions of any kind arising in connection with this raffle, that person's failure to win or redeem any prize, that person's tax liabilities with respect to that person's prizes, and that person's award of, acceptance of, or use of any prize; and (3) represents and warrants to Caerus Foundation, Inc that he/she has read and understands these Rules and agrees to be bound by these Rules and Caerus Foundation, Inc decisions as to the raffle, which are final. Caerus Foundation, Inc reserves the right to modify or amend these rules without notice at any time, so please read this page regularly to ensure that you are updated as to any changes.
